1. Acceptance of Terms
Welcome to Heartbeat ("Service", "we", "us", or "our"). By accessing or using our website monitoring service at heartbeat.pm, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
These Terms constitute a legally binding agreement between you and Heartbeat. We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
2. Service Description
Heartbeat provides uptime monitoring, website health checks, SSL certificate monitoring, DNS monitoring, heartbeat/cron job monitoring, and related services. Our Service allows you to:
- Monitor HTTP/HTTPS endpoints and websites
- Track SSL certificate expiration
- Monitor DNS records and domain status
- Set up heartbeat monitoring for cron jobs and scheduled tasks
- Create status pages to communicate with your users
- Receive alerts via email, Slack, Telegram, and Microsoft Teams
- Configure custom alert rules and notification preferences
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. Service features may change, and some features may be available only to paid subscribers.
3. Account Registration and Security
Account Creation
To use our Service, you must create an account by providing accurate and complete information. You may register using:
- Email and password
- Google OAuth authentication
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring your account information remains accurate and current
You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
4. Subscription Plans and Pricing
Free Plan (Developer)
Our free Developer plan is intended for personal, non-commercial use and includes:
- Up to 5 website monitors
- Up to 3 heartbeat monitors
- Basic monitoring features
Commercial or business use requires a paid subscription. We reserve the right to terminate free accounts used for commercial purposes without notice.
Paid Plans (Business & Enterprise)
Paid plans provide:
- Unlimited monitors and heartbeats
- Priority support
- Advanced features and integrations
- Higher check frequencies
Current pricing is available at heartbeat.pm/pricing. Prices are subject to change with 30 days' notice to existing subscribers.
5. Payment Terms
Billing
Paid subscriptions are billed in advance on a monthly or annual basis through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for:
- The subscription fee
- Any applicable taxes
- Automatic renewals until cancelled
Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage your subscription through your account settings or the Stripe customer portal.
Failed Payments
If payment fails, we will attempt to charge your payment method multiple times. If payment cannot be processed, we may:
- Suspend your account and monitoring services
- Downgrade your account to the free plan
- Terminate your account after repeated failed payment attempts
6. Refunds and Cancellation
Cancellation
You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.
Refund Policy
We offer a 14-day money-back guarantee for new subscriptions. If you're not satisfied within the first 14 days, contact us for a full refund.
After the 14-day period, we do not provide refunds for:
- Partial billing periods
- Unused services
- Account termination or suspension for Terms violations
Downgrades
If you downgrade to a lower-tier plan, the change takes effect at the end of your current billing period. No prorated refunds are provided for downgrades.
7. Acceptable Use Policy
You agree NOT to use our Service to:
- Monitor unauthorized systems - Only monitor websites and services you own or have explicit permission to monitor
- Violate laws - Engage in any illegal activities or violate applicable regulations
- Harm others - Harass, abuse, or harm other users or third parties
- Overload systems - Intentionally overwhelm or disrupt our infrastructure or monitored targets
- Circumvent limitations - Bypass account limits, rate limits, or access controls
- Share accounts - Allow multiple individuals to use a single account (except authorized team members)
- Resell services - Resell, redistribute, or sublicense our Service without written permission
- Reverse engineer - Attempt to reverse engineer, decompile, or extract source code from our Service
- Infringe rights - Violate intellectual property rights or other proprietary rights
- Transmit malware - Upload or transmit viruses, malware, or other malicious code
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.
8. Service Availability and Uptime
While we strive to maintain high availability, we do not guarantee uninterrupted service. The Service is provided "as is" and may be subject to:
- Scheduled maintenance (with advance notice when possible)
- Emergency maintenance and security updates
- Unforeseen technical difficulties
- Third-party service disruptions
- Force majeure events beyond our control
We are not liable for any damages resulting from service interruptions, data loss, or monitoring failures. Our Service is a monitoring tool and should not be your sole method of ensuring system availability.
9. User Content and Data
Your Content
You retain ownership of all data, configurations, and content you submit to our Service ("User Content"). This includes:
- Monitor configurations and URLs
- Alert rule settings
- Status page content
- API keys and integration settings
License to Us
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely to provide and improve our Service.
Your Responsibilities
You warrant that your User Content:
- Does not violate any laws or third-party rights
- Does not contain malware, viruses, or harmful code
- Does not infringe intellectual property rights
- Does not contain confidential information of others without authorization
Data Retention
We retain your User Content as described in our Privacy Policy. Upon account deletion, we will delete or anonymize your personal data in accordance with our data retention policies and legal obligations.
10. Intellectual Property Rights
The Service, including all content, features, functionality, software, and design, is owned by Heartbeat and is protected by international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or create derivative works of our Service
- Use our trademarks, logos, or branding without written permission
- Remove or alter any copyright, trademark, or proprietary notices
- Frame or mirror any part of the Service without authorization

11. Third-Party Services and Integrations
Our Service integrates with third-party platforms including:
- Stripe (payment processing)
- Google (OAuth authentication and analytics)
- Slack, Telegram, Microsoft Teams (notifications)
Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for the availability, functionality, or security of third-party services.
Links to external websites or services do not constitute endorsement. We are not responsible for content on third-party sites.
12. Disclaimers and Limitation of Liability
No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Accuracy, reliability, or availability of the Service
- Uninterrupted, secure, or error-free operation
- Freedom from viruses or harmful components
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTBEAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:
- Loss of profits, revenue, or business opportunities
- Data loss or corruption
- Service interruptions or downtime
- Costs of substitute services
- Damages resulting from monitoring failures or missed alerts
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Critical Systems Warning
IMPORTANT: Our Service is not designed or intended for use in critical systems where failure could lead to death, personal injury, or severe physical or environmental damage. You assume all risk for such use.
13. Indemnification
You agree to indemnify, defend, and hold harmless Heartbeat, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:
- Your use or misuse of the Service
- Violation of these Terms
- Violation of any laws or third-party rights
- Your User Content
- Unauthorized monitoring of systems
14. Termination
Termination by You
You may terminate your account at any time by:
- Cancelling your subscription through account settings
- Contacting our support team
Termination by Us
We reserve the right to suspend or terminate your account, with or without notice, for:
- Violation of these Terms
- Fraudulent activity or payment disputes
- Abuse of the Service or other users
- Extended periods of inactivity (free accounts)
- Any reason, at our sole discretion
Effect of Termination
Upon termination:
- Your access to the Service will be immediately revoked
- All monitoring and alerts will cease
- Your data may be deleted in accordance with our retention policies
- No refunds will be provided for terminations due to Terms violations
- Outstanding payment obligations remain due
15. Dispute Resolution and Governing Law
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through:
- Informal resolution - Contact us first to resolve disputes amicably
- Mediation - If informal resolution fails, we agree to participate in good-faith mediation
- Legal action - If necessary, disputes shall be resolved in the District Court of Nicosia, Cyprus
Class Action Waiver
You agree to resolve disputes with us individually and waive the right to participate in class actions, class arbitrations, or representative actions.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through:
- Email notification to your registered address
- Prominent notice on our website
- In-app notification when you log in
The "Last Updated" date at the top of this page indicates when changes were made. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
If you do not agree to the modified Terms, you must stop using the Service and may cancel your account.
17. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Heartbeat regarding the Service.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.
Force Majeure
We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or infrastructure failures.
